What is Chapter 7 Bankruptcy?

Chapter 7 Bankruptcy is a process where once you have completed the process through the bankruptcy court the court will cancel or discharge all of your debts, but you may have to return some of your property if there is a lien on it or you may keep it through a process called reaffirming. You might also have to sell some of your non-exempt property to pay your creditors. Chapter 7 is also called "liquidation" bankruptcy.

 

Who can file a Chapter 7 Bankruptcy?

If you have received a bankruptcy discharge in the last six to eight years you are not eligible to file a Chapter 7 bankruptcy. You also have to meet certain other criteria through what is called a means test.
